Corporate Insolvency Law and Practice in Kenya

Mathews Okoth is a Kenyan legal scholar, author and Advocate of the High Court of Kenya whose work brings together specialist commercial legal practice, university teaching and research. He is a Lecturer of Law and Chairperson of the Department of Commercial Law at South Eastern Kenya University School of Law, where he also serves in the University Senate. He holds a Master of Laws in Corporate Law from University College London, a Bachelor of Laws (Honours) from Moi University and a Postgraduate Diploma in Law from the Kenya School of Law, complemented by business studies at Edinburgh Business School, Heriot-Watt University. His professional experience spans private practice, corporate legal advisory work and academic leadership. He is also a Notary Public, Commissioner for Oaths and registered Patent Agent.

His scholarship focuses particularly on corporate law, corporate finance, insolvency, secured transactions and capital markets, informed by the practical challenges facing businesses, creditors and legal practitioners in Kenya. He is the author of Law of Corporate Finance in Kenya (2023) and Corporate Insolvency Law and Practice in Kenya, a work that places Kenyan legislation and judicial decisions at the centre of the study of financially distressed companies while drawing thoughtfully on comparative jurisprudence. Through his teaching, writing and legal practice, he seeks to advance rigorous, accessible and distinctly Kenyan commercial law scholarship, and to strengthen the connection between legal principles and the commercial realities they govern.
